Whilst two-thirds of people in this country die having never made a will, further complications can arise for your business partners and family if you fail to make adequate provision for the business on death. From a practical point of view would the business be able to continue without you? If the business cannot continue who would be able to run the business between the time of death and point of sale? There is also the issue of protecting the business from inheritance tax.

Andy, father of Rebecca (who has brittle bones) wanted to leave more money to her than his two step-sons, but his wife wanted the money to be divided equally.
In the second family, the grandfather Bruce, wanted to bypass his children and his autistic grandson in favour of leaving his half of the matrimonial estate to his remaining two grandchildren. This would affect his wife unfavourably if he died first and understandably it was not a popular idea.

In this episode, the main focus was on owning a business and what happens to the business after your death.
Both couples featured owned businesses that they had built up over a number of years and they wanted to ensure that their business would survive after they had passed away. The programme showed that family businesses can be vulnerable. Aside from the technical issues with the Memorandum and Articles of Association that needed to be dealt with, there were also emotional issues within the family to be taken into consideration.
