The aim of the Commercial Litigation team at Fisher Jones Greenwood LLP is to take a fair but firm approach when seeking to resolve a dispute. We offer a Partner-led service and the Commercial Litigation team is headed up by Partnership member James Burkett. James is recommended in the Legal 500 and has expertise in contractual and commercial disputes, professional negligence claims, construction disputes, banking disputes, option agreement disputes, off-shore trusts, employment issues, private international law, commercial Landlord and Tenant disputes, corporate insolvency, regulatory work, care homes, administrative law, European Community law: competition, health and safety and company law. James is a member of The Professional Negligence Lawyers’ Association, the Civil Litigation Section of the Law Society and the Association of Regulatory and Disciplinary Lawyers (ARDL).

James clients are both nationally and internationally based and some of his recent successes include:

  • Successfully represented four claimants in £2 million claim against an international group of companies: claims involved varied and complex legal arguments.
  • Successful representation of client involving a potential £25 million claim by large group of companies.
  • Successfully defended developer client in a Defective Premises Act claim relating to substantial heave damage claim.
  • Successfully resisted multi-party claim brought against property developer involving complex questions of causation.
  • Successful high value claim against International Currency Dealers, investigation of Service Agreements in UK and the USA.
  • Successfully defended nurses on multiple charges of misconduct brought against them by the Nursing and Midwifery Council.

Legal Update

Mister Justice Coulson QC, sitting at the TCC has delivered a leading authority which will be relied upon where a company in a CVA applies for a stay of enforcement.

There being no prior cases on the point, the Judge has ruled in Mead General Building Services Ltd v Dartmoor Properties Ltd [2009] EWHC 200 (TCC) that a stay of execution will not be automatically granted where the claimant is subject to a CVA
