Have a break, have a brexit

20 July 2016 by Ashton Carter

      Ashton Carter
Brexit, trademark, referendum, Brexit from the EU

Since the referendum, and the decision to exit from the EU (Brexit), it appears that many of the present government-cabinet-members simply haven’t got the ‘stomach’ for the road ahead. Hence the various resignations, reappointment’s and re-designations amongst ministers, under the new leadership of Theresa May.

      Brexit Trademark?

The same cannot be said for Biscuit manufacturers. Several brands have been desperately trying to get one over on their rivals by registering the trademark “Brexit”; before anyone else ‘wraps’ it up.

The rationale behind the desperation to register the infamous trademark is manufacturers hope to ‘pin’ their brand to said trademark; hoping that sales will be boosted by those who voted in favour of leaving the EU. It appears the manufacturers in question are hoping those who voted to remain will come around to the reality of Brexit from the EU; perhaps over a cup of “Brexit” tea.

Amongst the businesses based in Great Britain vying for the trademark are a Welsh biscuit provider, brand of tea, and a London brewery. However, the race doesn’t just extend to those on home soil. Companies in America have also been vying for the increasingly-illustrious trademark; including but not limited to the well-known beer producer, Sam Adams. Other US based interested parties include a company providing nutritional and dietary supplements.

      Different Trademarks?

Given the diversity of those involved in the scrap for the trademark, it appears many will be successful. This is because they can register the same trademark in different product markets and categories in which they operate respectively; as well as in their varying jurisdictions. How many of these trademarks will be rolled out to the various product markets is another matter entirely.

It remains to be seen, as to how many people will pop a crate, pack, bar or pot of “Brexit” in their weekly shopping trolley. Doing so may make supermarkets a dangerous place to be, for fear of political repercussions. However, those in the thick of it, clearly feel there’s value in the trademark and an opportunity to be had.

Here at Fisher Jones Greenwood LLP, our Corporate Commercial department can help you with all of your trademark needs, including registering new trademarks and checking those already registered, enforcing trademark or copyright and advising on the possibilities open to all types of businesses in relation to their intellectual property in general.

If you would like advice in relation to your businesses’ intellectual property needs and capabilities, please contact our Corporate Commercial Team on 01245 584515 or [email protected].
