There are various initial questions that will need to be addressed if you are in receipt of a planning refusal, for example:
- Can your reason for refusal be overcome?
- Do the reasons for refusal give an indication that a change in the scheme may assist with a new scheme moving forwards?
- A planning appeal is an option, but the chances of success are by no means certain
- Bear in mind that a planning appeal will take longer than a resubmission with a revised scheme
- Professional planning advice may be necessary in an attempt to overcome the reasons for refusal
- Often a solution can be found for an alternative scheme, but where some compromise may be necessary
In each case, it is best to take good, professional advice as to the chances of success, second time around and get your application right. Now, that may include meetings with the local authority to discuss an amended scheme; meetings with a parish council; attendance at planning committee; re-drawing plans; and making a statutory declaration. The point is that if you are going for it again, your application has to be carefully considered and has to address all the issues which caused the first planning refusal.
