There are many questions buyers will want to ask when looking to a buy a new build home. One of the most common questions we are asked to help with is what will happen to the roads in the new development?
Estate Roads
When you purchase a new build property the estate roads are likely to be adopted at some point in the future and your legal representative should check with the developer and the highways authority that a Section 38 Agreement has been entered into. This is an agreement between both parties that the developer will be responsible for the estate roads and is supported by a financial bond (issued by a bank or insurance company that there is a sufficient amount to cover against the developer breaching obligations on the Road Agreement.
When the draft papers are received from the developers’ legal representative this information will be checked and you will receive information on the estate roads of the development.
Sewers and Drains
Your legal representative should check whether the maintenance and ownership of the drains has or will be transferred to the water authority. It is important that a Section 104 Agreement and Bond has been entered into by the developer and Water Authority to protect the Buyer. This information will checked and reported to you.
