What is the first step in the divorce process?

The first step is to file a divorce application with the Court. This document initiates the legal process.

How long does it take to get a divorce?

The duration of the divorce process can vary, but it typically takes around six to nine months from filing the Application to receiving the final order, depending on the complexity of the case and the cooperation of both parties.

What are the grounds for divorce in the UK?

On 6 April 2022, the law on divorce in England and Wales changed to ‘No Fault Divorce’. It is no longer a requirement for spouses to prove anything other than that the marriage has irretrievably broken down by confirming this in the divorce application.

How is property divided in a divorce?

Property division is based on the principle of fairness. The Court considers various factors, including the length of the marriage, the needs of any children and parties, and the financial contributions of both parties. This can result in an equal or unequal division of assets.

What happens to our children during the divorce process?

Arrangements for children need to be made. These arrangements can be agreed upon mutually using Non-Court Dispute Resolution or, if necessary, through Court intervention to ensure the best interests of the children are prioritised.

Can I get spousal maintenance?

Spousal maintenance may be ordered if one spouse cannot support themselves financially after the divorce and the other spouse has the financial resources to be able to do so. The amount and duration of maintenance depend on factors such as the length of the marriage, the financial needs of both parties, and their earning capacities.

What is mediation, and how can it help?

Mediation is a form of alternative dispute resolution where a neutral third party helps the divorcing couple reach an agreement on various issues, such as property division and child arrangements, without going to Court. It can be a quicker, less stressful, and more cost-effective way to resolve disputes. The agreement reached is not legally binding, so further advice would be needed to decide on the best method to formalise that agreement.

Do I need a solicitor to get a divorce?

While it is possible to handle a divorce without a solicitor, having legal representation can help ensure that your rights are protected and that the process goes smoothly. A solicitor can provide expert advice, handle paperwork, and represent you in Court if necessary.

How much does it cost to get a divorce?

The cost of a divorce (not the financial settlement or child arrangements) can vary depending on the complexity of the case and whether it is disputed or not. There are Court fees, which currently stand at £612, and additional legal fees if you retain a solicitor.
